Insura App Terms

Insura App is a trading name of and provided by Mark Bates Ltd (company number 02946288).

The Terms and Conditions may be updated from time to time. We will notify you via the e-mail address you have provided and you will be bound by these new Terms and Conditions.

Insura App is open to customers that sign up to the application.

To be eligible for the Insura App you need to be aged 18 years or over, reside in the UK and have an active e-mail address.

Insura App is for personal use only. There is no corporate or business use.

Please ensure that all fields are completed accurately at the time of registration. It is your responsibility to keep these personal details up to date, so please notify us immediately if your details need updating.

Insura App accounts may be merged at our discretion if we see that you hold two or more accounts.

All offers and features available on the Insura App are at the discretion of Mark Bates Ltd and can be withdrawn at any time. All offers or benefits shown are subject to availability.

Any information collected through the Insura App will be handled in compliance with UK laws, data protection legislation and our Privacy and Cookies policy.

Mark Bates Ltd are not responsible for the delivery or quality of the goods, products or services supplied by third party organisations and any subsequent disputes that arise. Third party organisations may withdraw their products and offers from time to time and Mark Bates Limited are not responsible if an offer or insurance quote cannot be honoured or a product cannot be purchased for any reason.

If you sign up to The Premier Club rewards programme the The Premier Club Terms will also apply.

Support is available for both IOS and Android mobile devices.

• Requires IOS 14.0 or later and macOS 11.0 or later.
• Compatible with iPhone, iPad, iPad touch and Mac.

The Insura App offers free storage of digital photos and documentation to users who are entitled to use the Insura App.

When you upload image content to the Insura App the original resolution of your content may be affected. Furthermore, the following file size and type restrictions are in place:

• Existing Insurance - 10mb limit enforced in the app, no file type restriction.
• Key Dates - 10mb limit enforced in the app, no file type restriction.
• Avatar - 10mb and only PNG and JPG file type.

There is an upper limit on the amount of available storage space for each user of the Insura App. If this is exceeded, we will notify you.

You should always preserve your original content, or make back-up copies of such content, on your personal system. You should not use the Insura App as the only repository for your content. If your account is terminated in accordance with the Termination section of these Terms your access to the Insura App and your content will cease.

You represent and warrant that storing or processing your content or application will not violate any third party copyrights, trademarks or other rights. You are solely responsible for any such violations that you may incur as a result of your image data and we are exempt from any legal actions taken by others.

You are solely responsible for the content of the uploaded image data. You represent and warrant that the content of the uploaded image files do not violate the law, in particular legislation on the distribution of child pornography or other acts.

We are entitled, but not obliged to, check the appropriateness of the content you upload. We reserve the right to delete without further notice any of your content in whole or in part that violates applicable law. Illegal content may be reported to the appropriate authorities.

You shall bear full sole responsibility for any form of legal proceedings that may be incurred as a result of the images you upload and you shall be liable for any resulting damages. You will indemnify and hold harmless Mark Bates Limited from and against all losses, claims, liabilities, expenses, damages and costs, including reasonable legal fees, resulting from any violation of these Terms by you.

We shall have no liability for any temporary loss or discontinuance of service and we do not accept liability for any loss of any content, images or data you have uploaded. You are responsible for ensuring the back up of any such content, images and data. Furthermore, we do not accept any liability for the risks related to the Internet, in particular those related with uploading images to our Insura App.

The Insura App provides a briefcase and timeline function designed to assist with the management of insurance documents and other important dates.

You shall bear full sole responsibility for any required action when these dates fall due, whether for example this is to renew an insurance policy or pay a bill.

Mark Bates Ltd take no responsibility for any dates missed, policies not taken up, payments not made or offers missed.

Insura App is a tool designed to help you manage your existing insurance policies.

Removing a policy from the ‘My Briefcase’ area of our Insura App does not mean that the existing policy has been cancelled.

When an insurance policy has expired it will disappear from the timeline within ‘My Briefcase’. It is your responsibility to make sure the insurance renewed. Mark Bates Ltd take no responsibility for any dates missed, policies not taken up, payments not made or offers missed.

The ‘Monthly Spend’ amount is an estimate based upon all of the insurance policy information stored within ‘My Briefcase’. Whilst you can reduce your ‘Monthly Spend’ estimate by removing a policy, cancellations still need to be arranged with your provider and cancellation fees or refund conditions may apply. The monthly amount is not the amount you are paying each month. Legal Wills, Bills and Funeral Plans are not included in the monthly spend calculations.

If you take out a policy with an Insura App partner, then you may still need to contact your previous provider to cancel any insurance or direct debit.

It is your responsibility to ensure that you have the right level of insurance cover to meet your needs and particular circumstances. Mark Bates Ltd/Insura App are not responsible or liable for the management, delivery or quality of the insurance provided by any of the policies you have uploaded to the App and are not responsible or liable for any disputes that arise.

Any insurance offers shown in Insura App are at the discretion of Mark Bates Ltd and can be withdrawn at any time. All offers and insurances sold through the App are subject to qualifying conditions and eligibility. Any of our insurance partners can refuse to provide insurance if qualifying criteria are not met. Prices shown in quick quote are based on minimum premiums, the actual premium paid will be based upon the level of cover required and item/person being insured. Quotes are valid for 30 days, but can be withdrawn at the discretion of Mark Bates Ltd.

If at any time you want to terminate your membership of Insura App, please contact support@insura-app.com or ring 01476 591 104.

Accounts can be terminated or suspended, if we believe you may be breaching these Terms or displaying any fraudulent or suspicious activity.

We may terminate or suspend access to the Insura App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions.

All provisions of the Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warrant disclaimers, indemnity and limitations or liability.

The copyright in all material contained on, in, or available through the Insura App, including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof and all source code, software compilations and other material (“material“), is owned by or licensed to Mark Bates Ltd or its group of companies. All rights are reserved. You can view, print or download extracts of the material for your own personal use, but you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the material without our express permission.
